“The Company       ” is committed to protecting the privacy of personal data entered by its members (you) and providing services via the mobile application “GOLDIN”. When creating a personal account in our application, we will need you to provide some personal information that will help us complete your request and serve you professionally. By using the GOLDIN application, creating a personal account on it, and ordering products through it, you agree to the collection, use, transfer, processing, and monitoring of your personal information as described in this document.

Data Controller: Refers to our electronic application GOLDIN, which is responsible for determining the time, reason, and method of processing personal data and establishing policies in accordance with Law No. (30) of 2018 on the Protection of Personal Data applicable in the Kingdom of Bahrain.

Personal Data: Any information in any form relating to an identified or identifiable individual, in particular by reference to an identifier such as a personal identification number, or one or more physical, physiological, mental, cultural, economic, or social traits.

Sensitive Personal Data: Any personal information that directly or indirectly reveals an individual’s racial or ethnic origin, political opinions, philosophical beliefs, religious beliefs, trade union membership, criminal record, or any data related to its health or sexual status.

Processing: Any operation or set of operations performed on personal data, whether by automatic means or not, including collecting, recording, organizing, structuring, storing, adapting, altering, retrieving, using, disclosing by transmission, disseminating, or otherwise making available, aligning, blocking, erasing, or destroying personal data.

Data Subject: The individual or person to whom the personal data relates.

Clause No. (2): Nature of Privacy Policy

The purpose of the Privacy Policy is to provide you with information on the way of collecting and processing your personal data when you register as a member in our electronic application. When you provide us with the specified personal data in accordance with Clause No. 3 of this document, you will be able to complete your request and carry out electronic shopping via our application, and we will be able to manage our business in order to provide you with the best marketing services.

Clause No. (5): Marketing

You agree to the use of your personal data to inform you about our other products and services that may interest you, by sending notifications via the application to market some products or through advertisements that appear on the home page of the application. We may also market some products via phone calls, text messages, or your email, and share your personal data with third parties such as stores and companies contracted with us for the purpose of marketing their products.

Clause No. (6): Disclosure of information

Your personal data that is registered by you via our application will be transferred and stored on our servers, and third parties contracted with us may process or access your personal data, including but not limited to: banks, auditors, insurance companies, lawyers, other regulatory authorities, stores or those who own e-stores in the GOLDIN application, third-party service providers such as technology service providers and delivery service providers, and any regulatory authority or government entity. You acknowledge that in the event of a merger or partnership between us and a third party, we will transfer your data to our partners or our new company.

We also share your personal data within our application and with our subsidiaries, and we guarantee the protection of your personal data by requiring all our employees and subsidiaries to follow our protection rules when processing your personal data.

By sending your data to us, you agree to share it with third parties as required by the circumstances.

Clause No. (7): Data Security

We store your personal data on our secure servers and we encrypt your payment transactions through our application using encryption technology. When you provide your password to access our application, you are responsible for maintaining the security of your password within our application. Therefore, do not share your password with anyone. We ensure the protection of your personal data by using strict security features to prevent any attempts to lose, use, or access your personal data by unauthorized parties as much as possible. In case there is suspicion of any breach of your account, you and any relevant government agency will be notified if required to maintain your information.

We will keep your personal data as long as necessary to achieve the purposes stated in this document. You have the right, under certain circumstances, to request the correction of your personal data if it is inaccurate or not up-to-date. Clause No. (8): Prohibited Uses

As a member, you are not allowed to use the services and products offered on our electronic stores in our application in the following ways:

– Violating the laws applicable in the Kingdom of Bahrain or international laws.

– Using fraudulent and illegal methods, such as fraud and deception.

– Inflicting harm on others.

– Sending, uploading, or using any materials that do not comply with our content.

– Sending unwanted advertising materials through our application.

– Transferring or uploading materials that contain viruses, electronic bombs, spyware, or adware via our application or website.

– Not using, copying, or reselling any of the products or services that conflict with GOLDIN’s policy.

– Disabling any of the services offered via our application.

– Making negative comments about any of the electronic stores or our application, whether on our application or on social media, local newspapers, media channels, radio, or text messages.

– You are not allowed to resell your orders received via our application for the purpose of trade and profit.

– Disabling any of the services, networks, or programs used to provide our services.

Clause No. (9): Interactive Services

We are entitled to provide interactive services from time to time via our application, through the feature of requesting assistance, in order to receive complaints and suggestions from subscribed members. This also includes the ability for subscribed members to leave evaluations regarding the products, delivery services, or contracted e-commerce stores.

The use of any interactive services by minors is subject to the approval of their guardian or custodian, and the guardians or custodians shall monitor their children’s safety when using the internet.

Clause No. (10): Intellectual Property Rights

We – GOLDIN application – are the sole licensed owner of all intellectual property rights related to our application, its design, content, shape, concept, and the services it provides. These rights are protected by the Kingdom of Bahrain in accordance with all intellectual property protection laws.

 

Clause No. (11): Termination

In the event of any violation of any clause in this document or our usage policy, we are entitled to take necessary measures, including blocking your access to our application due to misuse. We are also entitled to resort to designated authorities to take necessary legal action.

Clause No. (12): Applicable Law in the Event of Dispute

This document and any dispute or claim arising out of or in connection with it, or its subject matter, shall be governed by and construed in accordance with the laws and regulations enacted in the Kingdom of Bahrain, and the courts of the Kingdom of Bahrain shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this document.
